Don't be fooled, there is no legal loophole for a rent hike above 2%
Our colleague Álvaro García de León, managing partner of the Real Estate Division Lener, collaborates in an article published in El Confidencial in which he analyses in which cases the limit of 2% of the rent increase is applied due to the CPI increase and inflation.
Álvaro García de León warns that, in those cases of rent increase for the aforesaid reasons mentioned, the most advisable course of action is to consult if the possibility of updating the rent to the CPI or any other indicator "is reflected in the contract", and that, in the event of such an update, it can only be raised when each year of validity of the contract is fulfilled and providing one month's forewarning, in accordance with the provisions of the Urban Leases Law (Ley de Arrendamientos Urbanos.)
