The practical development of the bankruptcy reform, which came into force almost two years ago, was the focus of the seminar given this week by Lener in Valladolid at the headquarters of Iberaval. This is an annual event in which the firm's professionals analyze in detail the new features of the reform. Eduardo Córdoba, managing partner of the Restructuring Department and head of the Valladolid office, together with Jesús Redondo, Manager of Lener's Restructuring Department, led this training session.
The insolvency reform came into force on September 26, 2022 with the aim of streamlining insolvency proceedings and ensuring the continuity of companies that are in financial difficulties but are viable. In order to learn in detail about the new features of the reform and its application, Lener gives a course every year for members of Iberaval, a guarantee company based mainly in Castilla y León.
Lener's experts, Eduardo Córdoba and Jesús Redondo, analyzed the criteria for the approval and homologation of the new restructuring plans and the possibilities of challenging them. In addition, they tried to provide solutions to the reality that the sector is going through, in view of the wave of insolvency proceedings without mass of individuals seeking exoneration of unsatisfied liabilities. In this context, Lener's professionals analyzed some cases in which financial creditors may be faced with a request for exoneration (also known as "second chance") in order to better protect their claims.
