Lener organised an informative breakfast on the new requirement to resort to ADR before filing a lawsuit
On 3 April, Organic Law 1/2025 on the efficiency of the Public Justice Service will come into force, which introduces a major change in access to the courts: it will be compulsory to resort to an appropriate means of dispute resolution (ADR) -such as mediation, conciliation or the intervention of a neutral third party- before filing a lawsuit.
With the aim of analysing the practical implications of this new obligation for companies, Lener organised an informative breakfast in our Madrid office, focusing on the key question: how to manage disputes with clients and suppliers in this new legal context?
During the session, the team of the Litigation and Arbitration Department represented by Noa Rodríguez, managing partner of the area; Borja Fiestas, associate; and Inés Tejera, lawyer of the department addressed the following issues:
It was a practical and participative session aimed primarily at in-house lawyers and heads of legal departments seeking to anticipate and make informed decisions.
