Fight against corruption: Independent Whistleblower Authority comes into force

On 1 September 2025, the Independent Whistleblower Protection Authority (AAI) will begin operating in Spain. This state body has been created to guarantee the protection of those who report serious offences, especially in cases of corruption, fraud or mismanagement of funds.
This new authority represents a significant change for organisations, as they will have to adapt their Internal Information Systems (S.I.I.) and reporting channels to the requirements of Law 2/2023 on Whistleblower Protection. Failure to comply with these obligations may result in financial penalties of up to €1 million.
In practical terms, the AAI will play a decisive role in:
- Verifying that companies have an adequate Internal Control System.
- Sanctioning those who do not comply with the regulations.
- Receiving and handling complaints, protecting the identity of the whistleblower.
- Promoting a culture of integrity and compliance in the business environment.
