Intervention is not contradiction: a single voice in insolvency qualification

The Commercial Court No. 4 of Madrid has resolved a relevant case regarding insolvency intervention: can the insolvent party and its insolvency administration defend themselves with contradictory arguments? The conclusion establishes that under the intervention regime only one procedural defence is possible, attributed exclusively to the insolvent party.
"Bankruptcy intervention is not a two-headed game. It is a single function. One defence," concludes Adriana.
The resolution, in addition to clarifying the scope of article 119 of the TRLC, sends a clear message: procedural coherence is not a formalism, but a guarantee of unity of defence, legal certainty and protection of the masses.
