We place the spotlight on this recent ruling issued by the High Court which upheld the conviction against a company which failed to fulfil the building and maintenance contracts it had entered into, with the latter having to compensate a proprietors’ association in Madrid to the amount of almost 600,000 euros. Amalio Miralles, the partner handling Receivership Matters at Lener, has taken part in and overseen the appeal and request for reversal stages, in his role as official receiver.
As is duly stated in the ruling, if the contracts were concluded backed by the express authorisation of the board of proprietors, their annulment likewise demands its backing.
