The Data Act, Europe's response to the data challenge in the digital economy

Europe accelerates the transformation of its digital ecosystem.

In this article for Cinco Días, our colleagues Sofía García Pascual and Enrique Requena, lawyers in Lener's information security and data protection department, analyse the scope of the DataAct and its impact on organisations.

The new law establishes a common legal framework in the EU to ensure more equitable access to data generated by connected products and services, promoting a more open, secure and competitive digital environment:

• Users will have the right to access and use the data they generate, sharing it with third parties or contracting new services.
• Companies and the public sector will have to comply with data sharing obligations, with safeguards against abuse.
• The regulation poses significant technical, legal and organisational challenges that will require a review of business models, contracts and data governance systems.
