Lener Asesores Legales has signed the framework agreement for the contracting of external legal support services to the Cofides fund, telematically.
With the formalization of the framework agreement with COFIDES, the panel of potential COFIDES advisers in the granting of aids is set up.
The external legal advice to this organization is responsible for verifying the concurrence of the requirements demanded in the granting of temporary public support measures under the Recapitalization Fund of companies affected by the pandemic caused by COVID-19.
The purpose of this recapitalization fund is to provide temporary public support under criteria of profitability, risk and impact on sustainable development. It has an endowment of 1,000 million euros to reinforce the solvency of companies with headquarters in Spain.
The advisers will verify compliance with the requirements that the companies applying for aids must meet in order to benefit from the extraordinary measures to support business solvency in response to the Covid-19 pandemic in execution of the provisions of article 17.7 of the Royal Decree-Law 5/2021, of March 12.
The legal and financial reports presented by the advisers are key for the funds to grant or not the amount requested to the companies.
The term of validity of the Framework Agreement will be until December 31, 2021 or the longer term that for the granting of temporary support measures charged to the Fund is determined by the European Commission in the Temporary Framework relating to state aid measures, intended to support the economy in the context of the current COVID-19 outbreak. In any case, the maximum duration may not exceed 4 years.
