Carmen Galán, Managing Partner of Lener's Labor Department, analyzes the new European agreement that regulates the system of Social Security contributions for those employees who work remotely in different countries where the company has its headquarters.
As a result, cross-border teleworkers may be governed by the legislation of the State in which the company has its headquarters and not by that of the country in which they usually reside. This exception may be requested by both the employer and the worker concerned, explains Carmen, without it being compulsory to request it to both countries involved, but it is sufficient to request it to the country where the company's head office is located.
This exception has a maximum duration of three years, extendable, reminds Carmen.
