Novelties in the right to conciliation and protection of working people

Through RD-Law 5/2023, which will enter into force on June 30, 2023, the Government introduces certain measures aimed at reinforcing the right to conciliation and the protection of workers. 

Among the main measures included in RD-Law 5/2023, we highlight the following: 

• A new unpaid parental leave of 8 weeks is included for the care of a child under 8 years of age.
• New paid leave of: (i) 5 days in case of accident or serious illness, hospitalization or surgery without hospitalization requiring home rest and (ii) 4 days in cases of force majeure.
• Other paid leave (e.g. marriage or death) is extended to domestic partners.
• The rights to the adaptation and reduction of working hours for the care of children or people with disabilities or who are unable to care for themselves are extended.
• Certain guarantees are established to ensure that workers do not suffer prejudice as a consequence of exercising these new reconciliation rights (e.g. reinforcement of the cases of nullity and declaration of the existence of discrimination based on sex).
• Reinforcement of the rights of single-parent families.
• The ERTEs of La Palma are extended until December 31, 2023.
• The prohibition of dismissal in companies benefiting from public aid is also extended until the end of 2023.
