Our colleague Javier García Ortiz, associate lawyer in Lener's Real Estate and Urban Planning Law Department, comments in Economist & Jurist on the advances in telematic procedures in notaries' offices brought about by the approval of Law 11/2023, of May 8.
From the beginning of the month, notaries will provide online services at the request of their clients, which will mean a significant time saving for the parties, providing greater agility to the legal traffic.
According to the General Council of Notaries, more than 3,200,000 notarial documents are expected to be authorized online each year.
In this way, notaries will be able to authorize a considerable number of legal procedures, including all corporate acts, from the incorporation of companies, to the appointment of positions, terminations, etc. They will also be able to authorize general meeting minutes and those of reference in the strict sense, commercial policies, among others.
The IT security of the process will be guaranteed by the use of the notaries' qualified electronic signature, their electronic headquarters and their private network, all developed by the Notary's technological center, Ancert.
