What are the consequences of the recent Supreme Court ruling for the coexistence of tourist apartments in neighborhood communities?
Our associate of the Real Estate and Urban Planning Department, Javier García Ortiz, analyzes in Cinco Días the consequences of this ruling that classifies as an economic activity the lucrative exploitation of properties intended for short-term stays.
However, the ban on the use of these properties in the communities, as for any other business, must be included in the bylaws of the community house, the modification of which requires the unanimous approval of the owners.
In any case, "the modification of the by-laws by unanimity that aims to contain this prohibition will not affect the owners who are already exercising the activity," reaffirms Javier García Ortiz.
