The reform of the Land Law, promoted by the Ministry of Housing, seeks to correct formal errors in urban development plans in order to avoid their invalidation and to provide greater stability and security to the urban development process. On May 23 it will be put to a vote in Congress.
Álvaro García, a partner at Lener and an expert in urban planning law, analyzes the bill for the parliamentary news outlet Demócrata. According to the Lener partner, "the reform would have allowed the correction of many of the general plans that have been canceled in recent years, such as those of Castellón, Vigo, Gijón or Marbella, by limiting the causes of nullity due to formal or procedural defects or by limiting the declaration of nullity to precepts without relevance with respect to the rest".
Regarding the new proposed way of calculating the compensation when the promotion of new developments is prevented or the conditions of the projects are changed, Álvaro comments that "in theory it is a more objective system that is more in line with the value of the property".
