The Council of Ministers has approved the draft bill on Procedural Efficiency of the Public Justice Service and the draft bill on Organizational Efficiency of the Public Justice Service.
The Procedural Efficiency Bill aims to streamline judicial proceedings through the resolution of disputes by means of alternative dispute resolution mechanisms ("ADR"), the simplification of the different judicial procedures and the promotion of the digitalization of courts and tribunals and the application of proceedings by telematic means. Specifically, in civil and commercial proceedings, the rule will require having attempted a consensual solution before filing the lawsuit through direct negotiation, independent expert opinion, conciliation, mediation or a confidential binding offer. This is intended to reduce litigation and court overload.
The Organizational Efficiency Bill, on the other hand, includes the creation of instance courts, the judicial office and municipal offices in order to promote territoriality, digitalization and equal access to Justice.
Since the bill is still at the drafting stage, it will be necessary to await any amendments that may be made to the articles of both texts.
