The “on demand work hours” cannot be add to a part-time job

After the modification of article 34 of the ET in the pre-election "social fridays", the lawsuits of the well-known "on demand work hours" are spreading. The legislative "urgency" has caused, almost a year later; that these issues remain unsolved in terms of scope and implementation. 

Carmen Galán, partner of Lener´s Labor Department, has commented in Expansión Jurídico a judgement of Labor Court number 1 of Bilbao, in which it is determined that an employee cannot have “on demand work hours” different from the agreed previously in a request of a part-time job, without their personal circumstances have changed and justifyng this new change. 

Lener's labor law team has been responsible for advising before and during the judicial process in the defense of this case.
